Scope

This Privacy Policy applies to personal information Bid Clarity collects through the Site and Services, including information submitted with contractor bids, estimates, proposals, plans, questions, messages, consultations, orders, and customer-support communications. This Privacy Policy does not apply to a third-party website or service that processes information independently under its own privacy policy. The Services are directed to users in the United States, and personal information collected through the Site and Services is processed in the United States.

Bid Clarity may collect personal information directly from you; automatically from your browser, device, or interaction with the Site after any notice and consent required by law; from documents and information you submit; from payment, hosting, scheduling, communications, artificial-intelligence, analytics, security, and other service providers; and from another person or organization that submits information on your behalf or includes information about you in a Submission.

Uploaded Documents and Contractor Information

You should submit only information reasonably necessary for the requested analysis and should remove personal or sensitive information that is not relevant to the Service. Bid Clarity may redact contractor-identifying information before or during analysis, including contractor names, license numbers, contact information, signatures, logos, and other direct identifiers. Automated tools may assist with redaction. Because identifying information may appear in document metadata, file names, photographs, handwritten content, unusual formatting, or other locations that are difficult to detect, Bid Clarity cannot guarantee that every identifier will be located or removed.

Artificial Intelligence and Automated Processing

Bid Clarity may use proprietary software, artificial intelligence, machine-learning systems, automated rules, databases, and third-party technology providers to redact, convert, process, analyze, and evaluate submitted materials and to generate or assist in generating reports and responses.

Bid Clarity does not authorize a service provider to use identifiable customer Submissions for the provider’s independent marketing, cross-context behavioral advertising, profiling, sale of data, or general-purpose model training. Service providers are authorized to process personal information only to perform services for Bid Clarity.

Bid Clarity uses personal information and Submissions to train, fine-tune, and evaluate the artificial-intelligence and machine-learning systems used to deliver the Services. Bid Clarity does not use personal information or Submissions to train general-purpose models offered to other customers, and does not permit any vendor to do so.

Cookies, Analytics, and Similar Technologies

The Site may use cookies, local storage, pixels, analytics tools, and similar technologies. Technologies strictly necessary to provide a feature you request, maintain security, prevent fraud, process a transaction, or preserve privacy choices may operate as needed. Optional analytics, advertising, live-chat, or similar technologies will be separately disclosed and, where applicable law requires consent, will not activate until you affirmatively choose to allow them. Bid Clarity does not use personal information for cross-context behavioral advertising.

California Invasion of Privacy Act — Communications and Recording

Bid Clarity intends to operate the Site and Services in a manner consistent with the California Invasion of Privacy Act and other applicable communications-privacy laws. Before Bid Clarity or a service provider uses an optional technology to record, collect, or transmit the contents or meaning of a chat, form entry, browsing session, telephone call, virtual consultation, or other communication, Bid Clarity will provide clear and conspicuous notice before the activity begins and will obtain affirmative consent where required by law.

A call or virtual consultation will not be recorded unless all participants receive advance notice and affirmatively consent before recording begins. Mere continued participation after a passive notice will not be treated as affirmative consent where applicable law requires more. A participant may decline recording.

How We Disclose Personal Information

Bid Clarity may disclose personal information to:

Bid Clarity does not disclose customer Submissions to contractors for marketing, referral, endorsement, or lead-generation purposes.

No Sale or Sharing of Personal Information

Bid Clarity does not sell personal information for money or other valuable consideration and does not share personal information for cross-context behavioral advertising. Bid Clarity has not sold or shared personal information during the preceding twelve months.

Bid Clarity provides a “Do Not Sell or Share My Personal Information” link in the Site footer and honors opt-out preference signals, including Global Privacy Control, transmitted by your browser or device. If these practices change, Bid Clarity will provide the notices and choices required by applicable law before the change takes effect.

Retention and Deletion

Bid Clarity retains each category of personal information only for as long as reasonably necessary and proportionate to provide the Services, fulfill the purposes described in this Privacy Policy, maintain security and integrity, resolve disputes, enforce agreements, satisfy legal or accounting obligations, and comply with lawful retention requirements.

Original uploaded bid files and identifiable working copies will not be retained longer than reasonably necessary to complete the analysis, deliver the report, respond to a limited report-related question or correction, investigate fraud or a security incident, resolve a dispute, or comply with a legal hold or other obligation.

Reports, order records, communications, contract-acceptance and consent records, security logs, and legal or accounting records may be retained longer when reasonably necessary for the applicable purpose.

Section 12

Data Security

Bid Clarity uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, acquisition, destruction, alteration, disclosure, or use. No method of electronic transmission or storage is completely secure. Bid Clarity therefore cannot guarantee absolute security. You are responsible for using secure devices and networks, protecting account credentials, and avoiding submission of unnecessary sensitive information.

California Privacy Rights

To the extent the California Consumer Privacy Act, as amended, applies to Bid Clarity, California residents may have the following rights:

You may submit a privacy request by emailing Adam@bidclarityconsulting.com with the subject line “Privacy Request.” Bid Clarity will acknowledge and respond to verified requests within the time required by applicable law, ordinarily forty-five days with possible extension.

Section 15

Children

The Site and Services are intended for persons eighteen years of age or older. Bid Clarity does not knowingly collect personal information from children under thirteen and does not knowingly sell or share the personal information of consumers under sixteen. If you believe a child has provided personal information, contact Bid Clarity so the information can be reviewed and deleted as appropriate.

Third-Party Websites and Services

The Site may contain links to third-party websites or may rely on third-party services. Bid Clarity is not responsible for independent privacy practices of third parties acting outside Bid Clarity’s instructions. Review the privacy policies of third-party websites and services before providing information to them.

Changes to This Privacy Policy

Bid Clarity may revise this Privacy Policy prospectively to reflect changes in the Services, technology, legal requirements, or privacy practices. The revised version will be posted on the Site with an updated effective date. If a change materially affects an ongoing account or materially expands the use of previously collected personal information, Bid Clarity will provide any additional notice or obtain any consent required by law.
